US Ban By Samsung In The Import Of The AT&T iPhone 4 & 3G iPads Due To Patent Dispute

The latest media news says that the import of some of the models of Apple iphone and iPads by Apple has been banned by ITC as a result of a patent dispute of Samsung. Today, the International Trade Commission has strictly restricted on the import of AT&T models of the iphone 4, the 3GS and 3G, the iPads 3G and the iPads 2-3G into the US with the strict cease and desist order.

Samsung clearly claimed that Apple is using a cellular data patent for developing the older versions of its iphone and iPads. In this context, ITC has clearly disagreed regarding the using of several other cellular patents by Apple though apple did not show any strong defense against this complain by Samsung. Apple as a defending measure has stated that Samsung by means of non-discriminatory (FRAND) terms has fairly agreed to give the proper licensing of their cellular patent to Apple. This statement has been provided by Apple to erase the threat of patent litigation by Samsung. This topic has invited a lot of arguments but it has failed to convince ITC. The FRAND terms of the FRAND patents were included in the battleground of several disputes in the past year which has been highly disapproved by FTC. Therefore, the comment of Apple automatically declined in the concerned matter.

Recently, on the basis of all the comments has finally landed with a flexible decision where Apple will be provided with a period of 60 days for getting the concerned thing vetoed in the White House. If it is not done then Apple will be appeal the decision with the ban determination scope of the customs. This kind of situation has also been experienced in the past with the infringement of the Apple’s patent by HTC’s One X and Evo 4G LTE. Later on, Samsung has clearly stated in its statement that the ITC decision has clearly proved the wrong utilization of their patent by Apple.
